1. Acceptance of Terms

By accessing or using the TrueAlert website (truealert.com) or any TrueAlert services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our website or services.

These Terms apply to all visitors, users, subscribers, and others who access or use TrueAlert’s website and services.

2. Services Description

TrueAlert provides personal emergency response systems (PERS), also known as medical alert systems, along with associated monitoring services, add-on features, and digital tools. Our services are designed to connect users with emergency assistance and designated contacts in the event of an emergency.

TrueAlert is NOT a substitute for calling 911 or other emergency services. In a life-threatening emergency, always call 911 directly.

3. Eligibility

Our services are intended for individuals 18 years of age or older. By using our services, you represent that you are at least 18 years old and have the legal authority to enter into these Terms.

4. Subscriptions and Billing

TrueAlert services are billed on a monthly basis unless an alternative billing arrangement is agreed upon in writing.

  • All plans are month-to-month. There are no long-term contracts or cancellation fees.
  • Subscription fees are charged in advance each billing period.
  • Equipment is provided as part of the service. Equipment remains the property of TrueAlert unless otherwise specified.
  • You authorize TrueAlert to charge the payment method on file for all applicable fees.
  • Price changes will be communicated with at least 30 days’ notice.

5. Cancellation

You may cancel your TrueAlert subscription at any time by calling 877-433-8626 or emailing support@truealert.com. Cancellations take effect at the end of the current billing period. No refunds are issued for partial months unless required by applicable law.

Upon cancellation, equipment must be returned within 30 days or a replacement fee will be charged.

6. Emergency Response Disclaimer

TrueAlert’s monitoring services are provided by third-party Five Diamond–certified emergency response centers. While we strive for the fastest possible response, TrueAlert cannot guarantee response times and is not liable for any injury, loss, or damage resulting from response delays, network outages, equipment malfunction, or other factors outside our control.

The user is responsible for ensuring the device is charged, worn, and functional at all times.

7. User Responsibilities

  • Provide accurate personal, medical, and emergency contact information at setup
  • Keep account information current and notify us of any changes
  • Charge and maintain your device in working order
  • Use the service only for its intended personal safety purpose
  • Not misuse or abuse the emergency monitoring service

8. Limitation of Liability

To the maximum extent permitted by law, TrueAlert and its partners shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of — or inability to use — our services, including but not limited to personal injury, property damage, or loss of life.

TrueAlert’s total liability to you for any claim arising under these Terms shall not exceed the total fees paid by you in the 3 months preceding the claim.

9. Intellectual Property

All content on the TrueAlert website — including text, graphics, logos, and software — is the property of True Alert LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Privacy

Your use of TrueAlert services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at truealert.com/privacy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Miami-Dade County, Florida.

12. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. Continued use of our services following the posting of changes constitutes your acceptance of such changes.
